1. Introduction
These Terms and Conditions ("Terms") govern the use of the services ("Services") provided by Hunter Marine Diesel. By engaging our Services, you ("Client" or "Customer") agree to be bound by these Terms. If you do not agree with these Terms, you must refrain from using our Services.
2. Scope of Services
Hunter Marine Diesel provides marine repair, maintenance, and installation services for boats, marine equipment and other industrial engines. Our services include, but are not limited to:
- Engine diagnostics, repairs, and maintenance
- Electrical systems inspection and repair
- Hull cleaning, maintenance, and repair
- Propeller, shaft, and drive system services
- Installation of marine equipment and accessories
- Consultation and advice on boat maintenance and troubleshooting
- Parts supply
The scope of each specific service will be defined in the service agreement or invoice provided to you.
3. Estimates and Pricing
- Estimates: We will provide, upon request, an estimate for services upon inspection of your vessel. This estimate will outline the expected labour, parts, and time required to complete the work. Please note that estimates are based on initial inspections, and unforeseen issues may arise during service that could lead to changes in the final price.
- Pricing: Any additional charges, including for parts or materials, will be clearly communicated and agreed upon before work begins.
- Changes to Estimates: If additional work is required beyond the original estimate, we will notify you before proceeding and obtain your approval.
4. Payment Terms
- Payment Schedule: Payment is due upon completion of the work unless otherwise agreed upon. We accept payment via credit card, direct deposit or cash.
- Late Payments: Any unpaid balances after 14 days will incur a 10% late fee. In the event of non-payment, Hunter Marine Diesel reserves the right to withhold the release of your vessel and or parts and is authorised to remove any parts that were fitted and remain unpaid.
- Refunds: Due to the nature of the services, all payments are non-refundable unless otherwise agreed in writing.
5. Client Responsibilities
You agree to:
- Provide accurate information regarding the condition of your vessel.
- Ensure that the boat is accessible for inspection and repair, including providing access to any necessary areas of the vessel.
- Inform us of any known issues or previous repairs that may affect the current work.
- Make timely payments in accordance with the agreed-upon schedule.
6. Warranty and Limitation of Liability
- Workmanship Warranty: We warrant that all work will be performed in a professional manner and in accordance with industry standards. Any defects in workmanship will be corrected at no additional cost for a period of 3 months from the date of service.
- Parts Warranty: Any parts supplied by Hunter Marine Diesel are covered by the manufacturer's warranty, if applicable. We are not responsible for defects in parts beyond the warranty period or for parts not provided by us.
- Limitation of Liability: To the fullest extent permitted by law, Hunter Marine Diesel is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including damage to the vessel, engine, or personal property.
7. Risk and Safety
Marine mechanics work with complex systems, and certain services may involve risks, such as engine operation, fuel systems, or electrical components. While we take precautions to prevent accidents and damage, you acknowledge that you are assuming responsibility for the vessel's condition and safety during the time the boat is in our care.
- Client Risk: You agree to hold Hunter Marine Diesel harmless for any injuries, damages, or losses resulting from risks associated with the vessel, including mechanical failure, leaks, or electrical malfunctions.
- Environmental Responsibility: We adhere to environmental regulations and will properly dispose of any hazardous materials in accordance with local laws.
8. Cancellation and Rescheduling
- Cancellation by Client: If you wish to cancel or reschedule a service, please notify us at least 24 hours in advance. Failure to do so may result in a cancellation fee.
- Cancellation by Hunter Marine Diesel: If we need to cancel or reschedule due to unforeseen circumstances, we will notify you as soon as possible and make reasonable efforts to accommodate you.
9. Insurance and Liability
- Insurance: Hunter Marine Diesel carries liability insurance for the services provided. However, we strongly recommend that you carry your own insurance for your vessel and any potential damage that could occur during service or repairs.
- Damage Liability: While we take all reasonable steps to protect your property, we are not responsible for pre-existing damage to your vessel, parts, or equipment, nor for damages incurred during the transportation, storage or testing of your vessel.
10. Dispute Resolution
Any disputes related to the Terms and Conditions or services provided by Hunter Marine Diesel shall be resolved through mediation or arbitration in New South Wales, Australia. By using our services, you agree to engage in good faith efforts to resolve any conflicts before taking legal action.
11. Shipping Policy for Parts
At Hunter Marine Diesel, we strive to provide timely and reliable shipping for all parts purchased through our services. The following outlines our shipping policies for parts:
11.1. Shipping Availability
We ship parts to customers located within Australia. We do not currently ship internationally outside of these regions unless otherwise specified.
11.2. Processing Time
Once you have placed an order for parts, please allow 3 business days for us to process and prepare your shipment, unless otherwise notified of delays or backorders.
11.3. Shipping Methods
We offer the following shipping methods:
- Standard Post: Delivery time is typically 3 to 4 business days, depending on the destination.
- Express Post: Delivery time is typically 1 to 2 business days for an additional charge.
We use Australia Post for all shipping.
11.4. Shipping Fees
Shipping fees for parts will vary based on the size, weight, and destination of the shipment. The shipping cost will be calculated and displayed at checkout or invoice before you complete your order.
11.5. Delivery Times
Estimated delivery times are provided by the shipping carrier and are subject to delays caused by factors such as weather, holidays, or other unexpected circumstances. While we strive to meet estimated delivery times, we cannot guarantee delivery dates and are not responsible for delays caused by the shipping carrier.
11.6. Inspection Upon Receipt
Upon receiving your parts shipment, please inspect the contents immediately. If there are any issues such as incorrect items, you must notify us within 7 days of delivery. You may contact our customer service at info@huntermarinediesel.com.au to initiate an or exchange for the incorrect item.
11.7. Returns and Exchanges of Parts
Our return and exchange policy for parts is as follows:
- Eligibility: We do accept returns for change of mind, incorrectly ordered parts, fitted, opened, used or modified goods. If Hunter Marine Diesel has made an error with the parts supplied, please email info@huntermarinediesel.com.au to initiate an exchange in line with clause 14.6.
- Return Shipping: If a return is required due to an error on our part (e.g., incorrect items), we will cover the cost of return shipping. For customer-initiated returns, you will be responsible for return shipping costs.
11.8. Shipping Damage or Lost Items
Once parcels have been posted with Australia Post Hunter Marine Diesel is not liable for any lost, stolen, damaged or missing parcels. Customers are encouraged to elect shipping insurance on parcels which will be an additional cost charged to the customer and required to be paid prior to shipping.
11.10. Shipping Address
It is the customer's responsibility to provide accurate and complete shipping information at the time of purchase. Hunter Marine Diesel is not responsible for delays or non-delivery due to incorrect or incomplete addresses provided by the customer.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
